Introduction
The Government of India Act, 1935 was the basis on which Constitution of India was drafted. It was a lengthy and a detailed document having 321 Sections and 10 Schedules.The salient features of the Government of India Act, 1935 are as follows:
1. It made Diarchy at the Centre apparent. Reserved and Transferred subjects were the two categories under the Federal List. The Governor-General was made in charge of the restricted or prohibited topics, and he nominated three advisers to assist him, in the management of these topics.
With the help of his Council of Ministers (not more than 10), the Governor-General oversaw the transferred subjects. The enactment of legislation required the Council to act with confidence.
2. Three lists were also created by the Act for the division of legislative authority, which are federal, provincial, and concurrent list. The Governor General may, at his discretion, empower the Federal Legislature or the Provincial Legislature to enact legislation on those topics that are not covered by any of the lists. Also, when the Federal Legislature is not in session, the Governor General had the authority to enact ordinances in an emergency.
3. The Legislative Assembly, which has a three-year term, and the Council of State, which has a five-year tenure, together constituted the bicameral Central Legislature established by this Act. Such Bicameral legislatures were established in Bombay, Bengal, Madras, Bihar, Assam, and the United Provinces.
4. Federal Court was formed by the Act. There was only one Chief Justice and no more than six judges on the Federal Court. The Court's jurisdiction was advisory, appellate, and original. The Federal States and all of British India were under the court's jurisdiction.
5. British India and the Princely States were to form the All India Federation. However, participation in the Federation was not required of the Princely States. The Federation envisioned by the Act was never created, as the rulers of the Indian States did not consent to it.
6. The Act also established the Federal, Provincial, and Joint Public Service Commissions, as well as the Reserve Bank of India.
