Introduction

British Prime Minister Clement Atlee announced in February 1947 that the British will vacate India by June 30, 1948. Immediately after that, the Muslim League started the demand for partition. The partition plan, also referred to as the Mountbatten Plan, was put forth by Lord Mountbatten in June 1947. The Congress and the Muslim League accepted the Lord Mountbatten plan, which was then implemented with the passage of the Indian Independence Act of 1947.

The following are the salient features of the Indian Independence Act of 1947:

1. The act created two dominions India and Pakistan.

2. On August 15, 1947, it ended the British rule in India and proclaimed it as an independent one.

3. The ability to pass laws for their respective dominions was granted to the constituent assembly of both dominions as a result of this act. Each of the two new dominions was granted full legislative autonomy and its own legislature; any act passed by the UK Parliament after August 15, 1947, was not to be applied to either of the new dominions. The Indian States would no longer be under the British Crown's rule.

4. It abolished the viceroy's position. The Governor-General of each dominion was to be chosen by the British King based on recommendations from the government of that dominion.

5. It abolished the position of "secretary of state for India" and transferred its duties to "secretary of state for commonwealth affairs".

6. The choice to remain independent or join the Dominion of India or Pakistan was presented to the princely kingdoms of India, by this act.

7. The Government of India Act 1935  created the basic structure of government until the new constitutions were developed and approved for both dominions. Still, the dominions were given the power to alter this statute.

8. A commission (chaired by Sir Cyril Radcliffe) was established to draw the borders between India and Pakistan.

9. Dominion India's first governor general was Lord Mountbatten and,
The first Governor General of a free India was C. Rajgopalachari.
